Terms of Service

1. General Information
1. Any client who commissions me automatically agrees to these terms of service.
2. I have the right to refuse any commission without explanation.
3. I reserve the right to change any and all information on this page and/or any and all prices at any time without warning. Commissioners that already ordered something at this point will not be affected or fully refunded.
4. I will not draw sexual contents (including genitalia) or humans. I will not draw hateful or offensive images. I will not draw fanart of series, books, movies, games, etc.
5. I reserve the right to ignore unreasonable, aggressive or offensive clients and claim the right to cancel any commission if the client behaves as stated above or for personal reasons. Payment will be refunded completely or in part as explained in 2.5.
6. Clear and precise visual references must be provided by the client. I will not accept purely text-based descriptions unless the client wishes to purchase designwork. I will charge an additional fee if you wish to purchase a design. I will not be responsible for mistakes on the final version due to incorrect or missing information.
7. The client must be the owner of whatever OC is supposed to be depicted or have permission by the original owner to have their OC used in commissions. Surprise gifts are okay but I will be the one to upload them and I will tag the original owner of the character (this rule has been implemented to thwart character theft).
8. I have the right to watermark the final version. The watermark must not be removed or made unrecognizable by the client or anyone else.
9. I exclusively own the full rights to the image. See: 4. Image Rights.
10. Basic communication skills in either English or German are required. I reserve the right to refuse commissions from clients that are unable to communicate with me properly.

2. Payment

1. Payment will be through Paypal only. I accept both USD and Euro. Other currencies must be replaced by USD or Euro. I will update my prices every now and then with the actual currency exchange rate. The client may chose whatever currency is cheaper if the exchange rate I used to calculate my prices is outdated.
2. Clients have to be of age or have someone of age make their payments for them.
3. Full payment is required after I finished the approval-sketch. I will not work any further without receiving the payment. Any type of commission labelled "sketch" has to be fully paid upfront. Please do not pay me before I told you so.
4. I do not accept payment by instalments. If you wish to purchase a larger type of commission you have to save up beforehand.
5. The client must provide the username used to request the commission in the transaction-information.
6. Clients get a full refund if:
-I cancel the commission for personal reasons before I started working.
-they cancel the commission before I started working.
Clients get a partial refund (the work that has already been done will be charged) if:
-I cancel the commission for personal reasons.
-they wish to cancel the commission for personal reasons.
-I cancel the commission because I feel they are unreasonable or offensive.
Clients won't get a refund if:
-the commission is done.
-the shading has already been started.
-they ordered anything less than lineart (sketches, IAC).
The client will be given what has been completed up until the point of refund.

3. Work method
1. I will provide WIPs (work in progress-images) on Deviantart and other social media. If your commission is a gift/surprise please inform me beforehand so I won't spoil it by uploading WIPs.
2. The client is encouraged to check in when they feel it's necessary for updates, assurance or reminders. Please keep point 1.5. in mind when doing so.
3. I do not accept deadlines. Please keep in mind that I'm an employee and not a freelancer and that I have to keep my priorities sorted out. I reserve the right to completely stop working on commissions temporarily if I am wrapped up in my day-work.
4. I try to finish commissions in the same order as they have been requested. However, I may use a smaller commission as a break from a larger commission type.
5. With the exception of any commission type labelled "sketch" I will provide an approval sketch. The client is encouraged and compelled to point out mistakes and voice their preferences until they're satisfied with the sketch.
6. After 3.5. I will wait until the payment is received before I work further. When the payment is received I will finish your commission as soon as I can and as my freetime allows it.
7. With the exception of sketches, I am always willing to make minor adjustments to the commission. I reserve the right to refuse changes that would need an unreasonable amount of additional work. The time for major edits is at the stage of the approval sketch. Please keep that in mind and be reasonable about it. The differentiation of minor and major edits lies with me and with me only.
8. I have a certain style of drawing. The client has to make sure that he wants that particular style of drawing. I reserve the right to refuse changes that I feel like are on the level of style.
9. I only ship the traditional parts of the commission to the client if the shipping costs and an additional 10€/13USD fee for the work it takes to ship are provided with the initial payment. Please speak to me about shipping before you make your payment so we can figure out how much it would cost from me to you.
10. I don't take responsibility for originals that get lost by the mailing service. I recommend ensured shipping for this very reason.

4. Image Rights
1. I alone have the full rights to my artwork. This means I may use and repost it wherever I want as well as make prints and merchandise. If the client disagrees with any of these uses a fee to have the artist opt out of them may be discussed on case by case basis. The right to post the image to my online galleries can not be opted out of, however, the client can request that their name be withheld from mention and the commission labeled as private.
2. The client may repost und use their commission publicly as long as credit is given back to me for the original artwork. If the client reposts the work on deviantart they may do so if they redirect to the original post in my gallery and disable comments as well as encourage the viewer to favorite the original work. The client may resize or crop the work to create icons, wallpapers or other graphics for non-commercial use only.
3. The client must not use the commission in any commercial way. The client may not alter the commission or have someone else alter it.
